PA to Receive $8.3 Million from EpiPen Settlement with Mylan, Inc.
According to a press release from the PA Office of Attorney General, Pennsylvania and the US Department of Justice have finalized a settlement with drug manufacturer Mylan, Inc., resolving claims Mylan overcharged for its EpiPen emergency allergy treatment. As part of the settlement, PA will receive $8.3 million (of the $456 million overall to the US government and states in the settlement). The $8.3 million restitution will go to the Medicaid program. The settlement resolves claims that from July 2010 to March 2017, Mylan submitted false statements to the Centers for Medicare and Medicaid Services, inaccurately classifying EpiPen as a generic rather than a brand-name drug, resulting in Mylan overcharging taxpayers. Mylan owns the rights to sell EpiPen in the US, and drug companies are responsible for ensuring their products are correctly classified. As part of the settlement, Mylan has also agreed to an outside annual review to ensure it is complying with the Medicaid rebate program.
